DMCA and Intellectual Property Policy

Gulf Coast Upholstery & Alterations respects the intellectual property of others and expects the same in return. This policy explains what we own, how we treat third-party rights in our product listings, and the process for reporting material on our website that you believe infringes your copyright.

Our Intellectual Property

The text, product photography, descriptions, page design, graphics, business name and logo on this website are owned by Gulf Coast Upholstery & Alterations or used with the owner’s permission. They are protected by United States copyright and trademark law. You may not reproduce, republish, distribute or use them commercially, including in marketplace listings or advertising, without our written consent.

Respect for Third-Party Rights

We do not copy the designs, photographs or written descriptions of other businesses, and we do not manufacture or sell items bearing another company’s logo, trademark or protected artwork. This includes printed and woven surface designs, which are protected in their own right even where no name appears on the product. If you believe a listing on our site does so, tell us and we will look at it promptly.

Fabric and Design References in Listings

Our covers are described by size, fabric type and construction. Where a third-party name appears in that context — a mill, a fiber technology, or a recognised style of weave — it is used descriptively and never to suggest that the product is made, licensed, endorsed or approved by that company. All trademarks remain the property of their respective owners. If a rights holder considers a reference on our site to go beyond fair descriptive use, we will amend or remove it on request.

Filing a DMCA Notice

If you own a copyright, or are authorized to act for the owner, and you believe material on this site infringes it, send a written notice to our designated contact below. Under the Digital Millennium Copyright Act, 17 U.S.C. §512(c)(3), your notice must include all of the following:

  • A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf

  • Identification of the copyrighted work you say has been infringed

  • Identification of the material on our site you say is infringing, with enough detail — a page URL is best — for us to locate it

  • Your name, mailing address, telephone number and email address

  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law

  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for them

Notices that omit any of these elements may not be actionable and may delay our response.

Our Response

On receiving a complete notice we will review it and, where the claim appears valid, remove or disable access to the material. We will make reasonable efforts to notify whoever posted or supplied it and provide them with a copy of the notice.

Counter-Notification

If material of yours has been removed and you believe the removal was a mistake or a misidentification, you may send a counter-notification containing your signature, identification of the removed material and the location where it appeared, a statement under penalty of perjury that you have a good-faith belief it was removed as a result of mistake or misidentification, your name, address and telephone number, and your consent to the jurisdiction of the federal court for the district in which you live, or of the Southern District of Alabama if you live outside the United States. We may restore the material 10 to 14 business days after forwarding a valid counter-notification, unless the original complainant tells us they have filed a court action.

Repeat Infringers

We will refuse service, remove content and decline future dealings with anyone we determine to be a repeat infringer of the intellectual property rights of others.

Misrepresentation

Section 512(f) of the DMCA imposes liability for damages, including costs and legal fees, on anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake. Please be certain of your position before sending a notice, and consider taking legal advice if you are unsure.

Changes to This Policy

We may update this policy as our listings or legal obligations change. The version on this page is the one in force, and its effective date is shown here.
