This website is operated by Gulf Coast Upholstery & Alterations. Throughout these terms, “we”, “us” and “our” refer to the business, and “you” refers to the visitor or customer. 2. About Us

Gulf Coast Upholstery & Alterations is an upholstery and alterations business based in Foley, Alabama, United States. We reupholster and repair furniture and alter garments for customers locally, and we sell ready-made throw pillow covers online. Our full contact details appear at the end of these terms.

3. Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order. Orders are accepted only from customers with a shipping and billing address within the United States. By ordering, you confirm that you meet these conditions and that the information you give us is accurate.

4. Products and Descriptions

We describe every product as accurately as we can, including dimensions, materials and construction. Colour is the one thing no description can control: screens vary, and a woven fabric photographed in daylight will not look identical on every monitor. Slight variation between production runs of the same fabric is normal and is not a fault. Where an item is made to order or cut to a customer’s measurements, that is stated on the product page and affects your cancellation and return rights.

5. Pricing

All prices are in U.S. dollars and exclude sales tax, which is added at checkout where applicable. We may change prices at any time, but the price displayed when you place an order is the price charged for it. If a product is listed at an obviously incorrect price because of a typographical or system error, we may cancel the order and refund you in full rather than honour the error, and we will tell you when this happens.

6. Orders

An order placed at checkout is an offer to buy. We accept it by sending an order confirmation email, and a contract is formed at that point. We may decline an order where an item is out of stock, where we cannot verify the payment or the delivery address, where an order appears fraudulent, or where the quantity ordered is inconsistent with retail use. Requests to change or cancel an order are governed by our Cancel & Change Order Policy.

7. Payment

We accept PayPal, debit cards and credit cards (Visa, Mastercard, American Express and Discover). All payments are processed through the PayPal gateway, which is PCI DSS certified, and a PayPal account is not required to pay by card. The full order total is taken at checkout. 8. Shipping

We ship to street addresses within the United States for a flat charge of $4.95 per order. Orders are prepared in 1 to 3 business days and take 5 to 7 business days in transit. Delivery estimates are provided by our carriers and are not guaranteed. Full terms, including our position on lost, delayed and damaged parcels, are set out in the Shipping Policy.

9. Returns and Refunds

Eligible items may be returned within 30 days of delivery on the terms set out in our Return & Refund Policy, which also lists the items that cannot be returned and explains who pays return shipping. Nothing in these terms limits any right you have under applicable consumer protection law.

10. Intellectual Property

All content on this website — text, photographs, product descriptions, page layouts, graphics and our business name and logo — belongs to Gulf Coast Upholstery & Alterations or is used with permission, and is protected by United States copyright and trademark law. You may view and print pages for your own personal use. You may not copy, republish, sell or use our content commercially, or use our name or logo, without written permission. Reports of infringement are handled under our DMCA & Intellectual Property Policy.

11. Acceptable Use

You agree not to use this website for any unlawful purpose, to attempt to gain unauthorized access to any part of it, to interfere with its operation, to scrape or harvest its content by automated means, or to submit false order or payment information. We may suspend access and decline orders where this section is breached.

12. Disclaimer of Warranties

The website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that a product will suit a purpose we have not been told about. Fabric performance depends heavily on how and where an item is used, and no claim on this site should be read as a guarantee of durability in a specific environment.

13. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of use or damage to other property, whether the claim is founded in contract, tort or otherwise, even if we were advised such damages were possible.

14. Indemnification

You agree to indemnify and hold harmless Gulf Coast Upholstery & Alterations, its owners and its staff against any claim, loss, liability or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the website, or your violation of the rights of a third party.

15. Governing Law and Jurisdiction

These terms and any dispute arising from them or from an order are governed by the laws of the State of Alabama, without regard to its conflict of law rules. You and we agree that the exclusive venue for any dispute is the state or federal courts located in Baldwin County, Alabama, and you consent to the personal jurisdiction of those courts.

16. Severability and Entire Agreement

If any provision of these terms is held to be unenforceable, that provision is severed and the remainder continues in full force. These terms, together with the policies referred to in them, form the entire agreement between you and us regarding the website and any order placed through it.

We may revise these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order. Continuing to use the site after a revision is published means you accept the updated terms.
